Terms of Use

This Premier Credit Consulting, LLC Web Site (this “Site”) Terms of Use Agreement (the “Terms of Use”) is between the party using this Site (“you”) and Premier Credit Consulting, LLC (“we” or “us”), with a principal place of business at 949 E Pioneer Rd, Suite B2, Draper, Utah 84020.  By using this Site you agree to be bound by the terms and conditions of use set forth in these Terms of Use.  This is a legally binding agreement.  Any use of this Site implies agreement with these terms and conditions.  If you do not agree to these terms you must leave this immediately.

1. We agree to provide access to this Site on an “as-is” basis in a manner consistent with these Terms of Use.  We make no warranties as to its use or applicability for any purpose.  This includes, but is not limited to all content, software, material, and information.  Premier Credit Consulting, LLC and its affiliates make no representation or warranty of any kind, that the content of this Site, its functionality, or operation is error free, free from defect or that any defects will be corrected.  In no instance will Premier Credit Consulting, LLC, or its affiliates be liable for any damages, real or assumed, direct or indirect, or punitive or consequential incurred as a result of the use of this Site, or the information or materials contained within it.  This includes, but not limited to, any loss of income or profits, damages to third parties, contractual responsibilities, negligence, or any tort.

2. You agree to use this Site in a manner consistent with these Terms of Use.  Any use of this Site implies that you have read and agree to these Terms of Use.  If you do not agree to these terms you must leave this Site immediately.

3. Access to and use of this Site and its content may be terminated at any time by either party by sending notice to the other party.

4. You hereby agree to indemnify, defend and hold Premier Credit Consulting, LLC, and all its officers, directors, owners, agents, employees, information providers, affiliates, (collectively, the “Indemnified Parties”) harmless from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms of Use including, without limitation, attorneys’ fees and costs.  You shall cooperate as fully as reasonably required in the defense of any claim.

5. Should any part of these Terms of Use be declared invalid or unenforceable by a court of competent jurisdiction, this shall not affect the validity of any remaining portion of these Terms of Use and such remaining portion shall remain in full force and effect as if the invalid portion of the Terms of Use had been omitted.

6. THESE TERMS OF USE AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF UTAH, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS.  SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS TERMS OF USE AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF UTAH.

CONSUMER CREDIT FILE RIGHTS UNDER STATE AND FEDERAL LAW

(Pursuant to Credit Repair Organizations Act, 15 U.S.C. Sec. 1679D)

You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly.  However, neither you nor a credit repair company or credit repair organization has the right to have accurate, current, and verifiable information removed from your credit report.  The credit bureau must remove accurate, negative information from your report only if it is over 7 years old.  Bankruptcy information can be reported up to 10 years.

You have a right to obtain a copy of your credit report from a credit bureau.  You may be charged a reasonable fee.  There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days.  The credit bureau must provide someone to help you interpret the information in your credit file.  You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

You have a right to sue a credit repair organization that violated the Credit Repair Organization Act.  This law prohibits deceptive practices by credit repair organizations.  You have the right to cancel your contract with any credit repair organization for any reason within three 3 business days from the date you signed it.  Credit bureaus are required to follow reasonable procedures to ensure that the information they report is accurate.  However, mistakes may occur.  You may, on your own, notify a credit bureau in writing that you dispute that accuracy of information in your credit file.  The credit bureau must then reinvestigate and modify or remove inaccurate or incomplete information.  The credit bureau may not charge any fee for this service.  Any pertinent information and copies of all documents you have concerning an error should be given to the credit bureau.

If the credit bureau’s reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the credit bureau, to be kept in your file, explaining why you think the record is inaccurate.  The credit bureau must include a summary of your statement about disputed information with any report it issues about you.  The Federal Trade Commission regulates credit bureaus and credit repair organizations.  For more information, contact: The Public Reference Branch, Federal Trade Commission, Washington, D.C. 20580

Privacy Policy

Premier Credit Consulting, LLC is committed to respecting the privacy of our users.  We strive to provide a safe, secure user experience.  This Privacy Statement sets forth the online data collection and usage policies and practices that apply to our Web Site.  By using Premier Credit Consulting, LLC, you consent to the policies and practices described in this statement (this “Privacy Statement”).

Your data will be stored and processed in whole or in part in the United States, if you access a Premier Credit Consulting, LLC web site (our “Site”) outside the United States, your usage of that Site constitutes consent to the transfer of your data out of your country and to the United States.

Collection and Retention of Information

In some areas of our Site, Premier Credit Consulting, LLC requests or may request that you provide personal information, including your name, address, e-mail address, telephone number, credit card number, social security number, contact information, billing information and any other information from which your identity is discernible.  In other areas, Premier Credit Consulting, LLC collects or may collect demographic information that is not unique to you such as your zip code, age, preferences, gender, interests and favorites.  Sometimes we collect or may collect a combination of the two types of information.

Since we believe that managing your credit is a life-long process, we retain indefinitely all the information we gather about you in an effort to make your repeat use with us more efficient, practical, and relevant.  Of course, you can correct or update your Premier Credit Consulting, LLC account profile at any time.  Moreover, you can close your Premier Credit Consulting, LLC account at any time, in which event we will remove all our copies of your Premier Credit Consulting, LLC account profile information, except for an archival copy that is not accessible on the Internet.

Use of Information by Premier Credit Consulting, LLC

We do not disclose to third parties your personal information, combined personal and demographic information or information about your use of Premier Credit Consulting, LLC (such as the areas you visit or the services you access), except as set forth in the following four paragraphs.

Premier Credit Consulting, LLC may also share aggregated anonymous information about visitors with its clients, partners and other third parties so that they may understand the kinds of visitors to Premier Credit Consulting, LLC’s Site and how those visitors use the Site.

Use of Cookies

Premier Credit Consulting, LLC web pages may contain electronic images known as web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages and to deliver co-branded services.  Web beacons are not used to access your personally identifiable information on Premier Credit Consulting, LLC; they are a technique we use to compile aggregated statistics about our Site usage

Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the web beacon resides.

Updating Your Information

When you place an order online at Premier Credit Consulting, LLC, your information is protected through the use of encryption, such as the Secure Socket Layer (“SSL”) protocol.  SSL makes it difficult for your credit card information to be intercepted or stolen while being transmitted.

Children

Premier Credit Consulting, LLC is not intended for children under 18 years of age.  We do not knowingly collect personal information from children under 18.
